Welcome to Finnext: AI Stock Forecasts(the “App”), an AI-powered application developed by PM Next s.r.o. (the “Company”, “we”, “us”, “our”). By accessing or using the App, you agree to these Terms and Conditions (the “Terms”). Please read them carefully.

Purpose of the App
1. The App provides:
  - AI-generated stock market forecasts and insights,
  - Market news and sentiment analysis,
  - Day Trading Ideas containing suggested entry, stop-loss, and profit-taking levels with reasoning, and
  - Finnext Academy, which provides structured educational materials, tutorials, and learning modules about trading, investing, and financial concepts.
2. All forecasts, Day Trading Ideas, and Academy materials (collectively, “AI Content”) are provided strictly for informational and educational purposes only.
3. AI Content does not constitute financial, investment, trading, legal, tax, or otherprofessional advice, nor any solicitation to buy or sell securities or engage in any strategy.
4. You agree that you alone are responsible for evaluating the information and for any actions or decisions you take using the App.
Acceptance of Terms
1. By creating an account, downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Eligibility
1. You must be at least 18 years old to use the App. If you are under 18, you must have the consent of a parent or guardian.
2. By using the App, you warrant that you comply with all applicable laws in your jurisdiction.
User Responsibilities
1. Use the App only for lawful purposes and in accordance with these Terms.
2. You must not:
  - Use the App for fraudulent, deceptive, unlawful, or abusive activities.
  - Attempt to gain unauthorized access to the App, user accounts, or third-party systems.
  - Interfere with the functionality, security, or operation of the App.
  - Misuse, redistribute, or publish AI Content in violation of laws or third-party rights.
Subscriptions, Free Trials, and Payments
1. The App operates on a subscription model. Payment is required to access premium features.
2. Subscriptions may renew automatically at the end of each billing period (weekly, monthly, or annually) unless canceled.
3. Free trials (if offered) convert to paid subscriptions unless canceled before the trial ends.
4. You authorize us (or the applicable app store) to charge your payment method for the applicable fees.
5. You may cancel at any time via your account or the applicable app store settings; cancellation takes effect at the end of the current billing cycle.
6. Refunds: We generally do not provide refunds for partial billing periods unless required by law or the applicable app store’s policies.
7. Price changes may occur and will take effect in the next billing cycle after notice.
Account Security
1. You are responsible for maintaining the confidentiality of your login credentials.
2. Notify us immediately of any unauthorized access or security breach.
3. We are not liable for losses arising from unauthorized use of your account.
Use of Predictive Reports, Day Trading Ideas, and Finnext Academy
1. AI Content (including forecasts, Day Trading Ideas, and Finnext Academy materials) is intended solely for personal, informational, and educational use.
2. None of the content should be treated as personalized investment or trading advice tailored to your financial circumstances, objectives, or risk profile.
3. Day Trading Ideas are prepared and selected daily by AI systems operated by the Company and distributed to all users equally. They are not based on user inputs.
4. Finnext Academy provides learning modules, guides, and educational resources for general knowledge. These materials are not intended as financial or investment recommendations.
5. Risk Warning: Day trading and investing involve substantial risk. You may lose some or all of your invested capital.
6. The Company disclaims liability for any losses or damages arising from reliance on AI Content or your trading decisions.
Compliance with Laws
1. You agree to comply with all applicable local, state, national, and international laws, rules, and regulations in connection with your use of the App.
Intellectual Property; User Inputs
1. The App, AI models, forecasts, Finnext Academy content, and related materials are owned by the Company and protected by intellectual property laws.
2. You retain ownership of your personal data and inputs.
3. We may analyze and use anonymized or aggregated data to improve the App.
4. You may not copy, distribute, or create derivative works from AI Content (including Academy materials) without prior written consent.
Data Usage and Privacy
1. Your use of the App is subject to our Privacy Policy (linked in-app/website).
2. AI Content may be unique to your inputs and is not shared with other users unless required by law or as described in the Privacy Policy.
Service Availability and Disruptions
1. The App relies on external services (e.g., data feeds, AI providers, news sources). Uninterrupted or error-free operation is not guaranteed.
2. We are not liable for interruptions due to maintenance, updates, outages, third-party failures, or events beyond our control.
3. Features may be updated, suspended, or discontinued at any time.
App Updates & Modifications
1. We may update, modify, or discontinue features (including AI models and Day Trading Ideas) at any time.
2. We have no obligation to provide ongoing support.
3. You are responsible for using the latest version of the App.
Force Majeure
1. We are not liable for delays or failures caused by events beyond our reasonable control (including natural disasters, war, terrorism, pandemics, government actions, infrastructure failures, or third-party service disruptions).
Disclaimers
1. The App is provided “as is” and “as available” without warranties of any kind.
2. No Financial Advice: AI Content (including forecasts, Day Trading Ideas, and Finnext Academy materials) is not financial, investment, or trading advice.
3. No Guarantee: AI Content is based on probabilistic models, historical data, educational resources, and third-party information. Accuracy, completeness, or reliability is not guaranteed.
4. Hypothetical/Backtested Performance (if shown) is for illustration only and does not reflect actual trading or future results.
5. Third-Party Content (market news, data, sentiment) is obtained from third parties; we do not warrant its accuracy, timeliness, or completeness.
6. You use the App at your own risk.
Limitation of Liability
1. To the maximum extent permitted by law, the Company and its affiliates, officers, employees, contractors, and providers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or trading losses, arising out of or related to your use of (or inability to use) the App or AI Content.
2. Where limitations are not permitted, our total aggregate liability shall not exceed the greater of (a) the amount you paid to us in the three (3) months preceding the event giving rise to the claim, or (b)€50.
Indemnification
1. You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, employees, and service providers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the App or AI Content; (b) your violation of these Terms; or (c) your violation of any law or third-party rights.
Termination
1. We may suspend or terminate your access to the App at any time if you violate these Terms or if required by law.
2. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive (including 7, 9, 10, 11, 13–19, 21–24) shall survive termination.
Governing Law
1. These Terms are governed by the laws of Slovakia. Because the App operates globally, you agree that any disputes will be resolved under Slovak law, without regard to conflict-of- laws principles. Where applicable, mandatory local consumer-protection rules in your jurisdiction may also apply.
Changes to These Terms
1. We may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the updated Terms. When required by law, we will provide appropriate notice.

Regulatory Status; No Advisory Relationship
1. The Company is not a registered investment adviser, broker-dealer, portfolio manager, or financial institution, and does not provide fiduciary services.
2. No client-adviser relationship is created by your use of the App or by any AI Content.
3. You are solely responsible for your investment decisions, including suitability, diversification, and risk management.
Self-Directed Users; Execution & Costs
1. The App does not execute trades. Any trades you place are through your chosen broker, at your discretion and risk.
2. You are responsible for all commissions, fees, taxes, financing costs, and other charges related to your trading.
Geographic Restrictions
1. The App may not be available or appropriate in all jurisdictions. Accessing the App from locations where its content or features are illegal is prohibited.
2. We may restrict access to certain features (including Day Trading Ideas) in specific regions to comply with local rules.
No Waiver; Severability
1. Our failure to enforce any provision is not a waiver of our rights.
2. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
